9. Limitation of liability & Warranty
9.1 Savings Made Easy acknowledges that provisions in the Competition and Consumer Act 2010 (Cth) (as amended) and other statutes from time to time in force imply or impose statutory guarantees, conditions or warranties into contracts for the supply of services which cannot be excluded, restricted or modified or can only be restricted or modified to a limited extent (Non Excludable Terms). Nothing in these Terms is intended to exclude or restrict the application of the Non Excludable Terms. Other than the Non Excludable Terms, Savings Made Easy hereby excludes all conditions, warranties, guarantees, terms and obligations expressed or implied by law in connection with these Terms, or any services provided under them.
9.2 Savings Made Easy is not liable to you or any other person for any loss or claim of any kind in connection with these Terms, or any services provided under them, except to the extent caused directly by the negligence or wilful misconduct of Savings Made Easy.
9.3 If any Non Excludable Terms apply, then to the extent to which Savings Made Easy is entitled to do so, its liability under those Non Excludable Terms will be limited at its option to:
   a) the supplying of the services again; or
   b) the payment of the cost (if any) of having the services supplied again.
9.4 To the extent permitted by law, Savings Made Easy will be under no liability to you or any third party in any circumstances for any indirect, special or consequential loss or damage, including but not limited to loss of revenue or loss of profit howsoever arising and whether in an action in contract, tort, in equity, under statute, or on any other basis.
9.5 Notwithstanding anything to the contrary contained in these Terms, Savings Made Easy’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Savings Made Easy for our services during the term of your use of the Site.

10. Indemnity
10.1 To the extent permitted by law, you agree to indemnify us against any claim, loss, liability or damage, costs, charges and expenses (including our legal costs on a solicitor/ own client basis) suffered or incurred by us which arise directly or indirectly in relation to your use of the Site or associated services in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth in these Terms.

11. Notice
You agree to promptly inform us of any breach by you of these Terms and of any conduct of any other person which you think may be a breach of these Terms, whether the conduct has ceased, is continuing, or may occur in the future.

12. Termination
12.1 Termination of these Terms will not end those provisions that are capable of surviving the ending of this agreement.
12.2 Savings Made Easy may modify these Terms at any time and such modification will become effective upon positing on the Site.
12.3 Should any part of these Terms and disclaimers be held to be void or unlawful, such part is to be read and enforced as if the void or unlawful part had been deleted.

13. Intellectual property
13.1 You must not infringe any intellectual property rights owned by Savings Made Easy, or the intellectual property rights of any third party. You agree to indemnify Savings Made Easy against any action taken by a third party against it in respect of any such infringement.

14. General
14.1 These Terms are made in and governed by the laws of Victoria, Australia. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Victoria, Australia.
14.2 The failure by us to exercise or enforce any right or provision in these Terms shall not operate as a waiver of such a right or provision.
14.3 Should any part of these Terms and disclaimers be held to be void or unlawful, such part is to be read and enforced as if the void or unlawful part had been deleted.
14.4 Unless otherwise specified, this agreement constitutes the entire agreement between the customer and Savings Made Easy with respect to the Site or the products offered on the Site.
